By accessing or using InSifter ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. InSifter reserves the right to update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
InSifter is an intelligence platform for independent insurance agents that provides crowdsourced carrier and aggregator data, including but not limited to commission rates, trust scores, reviews, territorial availability, appointment information, and comparison tools. The Platform offers both free and paid subscription tiers.
To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You must notify InSifter immediately of any unauthorized use of your account.
InSifter relies on data contributed by users, including ratings, reviews, commission data, and other information ("User Content"). By submitting User Content, you represent and warrant that:
You grant InSifter a non-exclusive, worldwide, royalty-free, perpetual license to use, display, aggregate, and analyze User Content to operate and improve the Platform. InSifter may display User Content anonymously and in aggregate form.
You agree not to:
All content on the Platform — including but not limited to the design, code, data compilations, graphics, logos, icons, text, and software — is the property of InSifter or its licensors and is protected by copyright, trademark, and other intellectual property laws. The InSifter name, logo, and all related marks are trademarks of InSifter. You may not use, reproduce, or distribute any InSifter intellectual property without prior written consent.
InSifter aggregates data from multiple sources including user contributions, publicly available information, and industry publications. InSifter does not guarantee the accuracy, completeness, or timeliness of any data on the Platform. Commission rates, carrier ratings, aggregator fees, and other data points are based on user-reported information and may not reflect current or official figures. Users should independently verify any data before making business decisions. InSifter is not a licensed insurance advisor and does not provide insurance, financial, or legal advice.
InSifter offers a free tier and a paid "Pro" subscription. By subscribing to Pro, you agree to pay the applicable subscription fees. Subscriptions are billed monthly and automatically renew unless canceled. You may cancel your subscription at any time through your account settings. Refunds are not provided for partial billing periods. InSifter reserves the right to change subscription pricing with 30 days' notice to existing subscribers.
To the fullest extent permitted by law, InSifter and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform. InSifter's total liability for any claim arising from these Terms or the Platform shall not exceed the total amount you paid to InSifter in the twelve months preceding the claim. The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied.
You agree to indemnify, defend, and hold harmless InSifter and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, your User Content, or your violation of these Terms.
InSifter may suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to access the Platform ceases immediately. Sections regarding intellectual property, limitation of liability, indemnification, and any other provisions that by their nature should survive termination will survive.
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless both parties agree to alternative resolution.
